Terms & Conditions
1. Scope of Service
LayerTry is a Shopify app that lets merchants offer an AI-powered virtual try-on experience on their storefront. The service may include storefront widgets, analytics, AI-generated try-on previews, usage controls, logs, and related merchant tools. By installing, activating, or using LayerTry, you agree to these Terms & Conditions.
2. Merchant Account and Store Responsibility
You are responsible for your Shopify store, your product catalogue, your storefront content, and the way you present LayerTry to shoppers. You are also responsible for ensuring that any product images, customer communications, policies, and disclosures used with LayerTry comply with applicable law, platform rules, and your own brand standards.
3. Shopper Photos and Input Data
When a shopper uses the widget, LayerTry may process the shopper photo, prompt, product image, product metadata, device information, country, event timestamps, and related technical data required to generate and review a try-on result. Shopper photos are processed only for operating the LayerTry service, including photo checks, prompt assistance, result generation, quality review, troubleshooting, fraud prevention, and merchant analytics.
4. AI Processing and Generated Outputs
LayerTry uses third-party AI and infrastructure providers to analyse product images, analyse shopper photos, assist with prompt creation, generate try-on previews, and evaluate output quality. AI outputs are probabilistic and may be incomplete, inaccurate, stylised, or unrealistic. LayerTry does not guarantee that any generated preview is photorealistic, merchant-approved, error-free, or suitable for every product category. You are responsible for deciding whether and how to rely on generated outputs in your store.
Generated previews are illustrative only and do not represent guaranteed real-world fit, sizing, fabric drape, color accuracy, or how a product will actually look on the shopper. Merchants and shoppers should not rely on generated previews as a substitute for sizing guides, real photography, or in-person assessment.
5. Merchant Dashboard Data
LayerTry may store operational and reporting data connected to your store, including try-on records, prompts, AI-generated descriptions, filter outcomes, quality reviews, usage metrics, funnel events, rate-limit events, and subscription metadata. This data is used to operate the service, provide analytics, detect misuse, improve reliability, and support merchants.
6. Privacy and Legal Compliance
You are responsible for providing any legally required notices, disclosures, and consent flows to your shoppers before they upload photos or other personal data into the widget. This includes updating your privacy policy and any applicable consent language to reflect the use of LayerTry and related AI processing. If your business is subject to GDPR, UK GDPR, CCPA, or similar laws, you remain responsible for complying with those laws in relation to your use of the service.
7. Data Retention and Deletion
Data retention varies by data type and service need. Store-level records, analytics, and operational logs are retained while your subscription is active and for a limited period after uninstall, where necessary for reinstalls, fraud prevention, support, dispute handling, or legal compliance.
LayerTry is fully compliant with the GDPR-mandated data handling requirements set by Shopify, and processes the standard compliance requests as follows:
Shopper data requests — when a shopper asks the merchant for a copy of their data, LayerTry provides a summary of the try-on activity tied to that shopper. LayerTry does not collect or store shopper email, name, or contact information.
Shopper data deletion — when a shopper asks the merchant to delete their data, LayerTry permanently deletes the try-on records and any stored images associated with that shopper, in line with Shopify's standard timing for redact requests.
Merchant data deletion — when a merchant uninstalls LayerTry, all data tied to the shop is permanently deleted within Shopify's standard 48-hour uninstall window. After deletion, no merchant or shopper data remains in LayerTry.
8. Rate Limits, Filters, and Service Controls
LayerTry may apply plan limits, daily caps, per-visitor limits, content filters, abuse controls, temporary blocks, or other operational safeguards. Some submissions may be rejected before generation if the shopper image is unsuitable, unsafe, unsupported, or inconsistent with the selected product. LayerTry may change these controls when necessary to protect service reliability, control infrastructure cost, or reduce abuse.
9. Acceptable Use
You may not use LayerTry to process or generate unlawful, abusive, infringing, deceptive, sexually explicit, violent, hateful, or otherwise prohibited content. You may not use the service to impersonate individuals, misrepresent products, scrape the service, probe for weaknesses, bypass limits, or abuse underlying AI providers. LayerTry may suspend or limit access where misuse, fraud, or unusual risk is detected.
You may not upload or attempt to generate try-ons of minors. Submissions that appear to depict children may be rejected automatically, and merchants are responsible for ensuring the widget is not used by or on behalf of minors in violation of applicable law.
10. Availability and Changes
LayerTry may update features, prompts, models, providers, analytics, user interface, and operational logic over time. Features may be added, changed, or removed. We do not guarantee uninterrupted availability, identical outputs over time, or compatibility with every Shopify theme, browser, device, or product type.
11. Limitation of Liability
LayerTry is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, LayerTry disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. LayerTry will not be liable for indirect, incidental, consequential, special, or punitive damages, including lost revenue, lost profits, brand harm, customer disputes, or business interruption arising from use of the service or reliance on AI-generated outputs.
12. Third-Party Services
LayerTry depends on third-party platforms and providers, including Shopify, hosting, storage, and AI providers. Availability, latency, output quality, and billing mechanics may be affected by those providers. LayerTry is not responsible for outages, policy changes, pricing changes, or technical limitations imposed by those third parties.
13. Updates to These Terms
We may update these Terms & Conditions from time to time to reflect product changes, legal requirements, or operational needs. The updated version becomes effective when posted in the app unless a later effective date is stated. Continued use of LayerTry after an update takes effect means you accept the revised terms.
